HANDLING OF PERSONAL DATA AND CONFIDENTIALITY POLICY
UBS is aware of your concern with the handling of your personal and financial information (hereafter called “Data”), which is electronically stored and/or received and/or sent through this website. In that regard, we use rigorous security and confidentiality standards to any information that our clients share with us and for that purpose we developed the present Privacy Policy (hereafter called “Policy”), which is meant to clarify the procedures developed by UBS to protect your Data.

UBS declares that it potentially might make available some links on the UBS website to websites not operated, controlled or of the responsibility of UBS (third party sites). UBS expressly declares that the present Policy applies exclusively to the UBS website, and is not applicable to third party sites.

Targeting the improvement of the privacy procedures used by UBS and its commitment to the security of its clients’ Data, the present Policy may be modified without previous notice. Therefore, it is recommended that you regularly consult this page as to become familiar with potential changes. The last paragraph of the present Policy will indicate the last updating date. The terms of the present Policy simultaneously apply to specific terms agreed with UBS, and if there is a potential conflict, specific contractual terms will always prevail.

DATA TRANSFER TO UBS AND THE INTERNATIONAL INFORMATION FLOW
UBS clarifies that the Internet is generally not a totally secure environment and that the Data exchanged through it , i.e. e-mail, may be lost or intercepted/accessed by non-authorized third parties, what may potentially result in undue use (disclosure, adulteration, etc.). UBS is not responsible for the security and/or confidentiality of Data sent via Internet to or from USB (upon user’s request) on the electronic trail between the transmitter of the message and the final addressee, nor shall it guarantee the actual receipt of such information.

Moreover, we clarify that Data sent through the Internet may circulate in different countries, in spit of the fact that both, sender and addressee belong to the same country. Thus, UBS warns that the Data might circulate in a country in which the level of data protection is llower than that existing in the country of residence of the sender.

In specific situations, UBS may make available a special coded system for Data transmission, which will be formally appointed by USB for this purpose.

Finally, UBS emphasizes that the client may chose other ways of communication with UBS, which do not involve the Internet, whenever s/he deems necessary and/or appropriate.

DATA PROCESSING BY UBS AND UTILIZATION FOR MARKETING PURPOSES
UBS does not collect data related to personal information from this website, except when previously authorized by the client himself or herself. In the latter case, always observing the applicable legislation, UBS may use the personal information made available on the UBS website to commercialize products and services that USB deems to be of interest to its clients.

USE OF COOKIES
UBS may utilize “cookies”1 or “web bugs” 2 to obtain non-personal data used on the UBS website, including the “IP address” and the 3 “session number”4. This data shall be collected mainly for the purposes of administration or the compilation of demographic data and monitoring the use and performance of this website. Furthermore, UBS may use “cookies” to facilitate the movement of its clients on the page (i. e., to remember passwords during the session, record choices, etc.)

The user may make the “bugs” inactive disabling the “JavaScript” language on the browser, through the security configurations. However after deactivation, the site might not function correctly. Moreover, it is possible to configure the browser so as to deactivate the “cookies” eventually used by UBS:

DATA SECURITY
At UBS, your Data shall be transmitted and stored in protected systems (i.e, “Firewalls”). UBS is committed to take all possible and reasonable measures so as to not permit that the personal Data of its clients become available to third parties, except in cases in which USB utilizes service providers contractually obligated to confidentiality, who need to have access to our Data. In addition, the Data shall only be disclosed to third parties to meet a legal, regulatory, judicial or authoritative body’s request. UBS reserves the right to store Data in specific locations in the client’s native country. Moreover, in these cases, UBS will put forth its best efforts to guarantee adequate levels of Data protection, taking into consideration the applicable legal and regulatory provisions, including those related to banking secrecy and data protection.
